TERMS OF SERVICE / VERSION 2026-09-16

These terms explain your responsibilities when using Kaizen and what you can expect from the service. Terms date: 16 September 2026. Read them together with the Privacy Policy.

1. The service and your agreement

Kaizen is operated by Brian Bichage in Nairobi, Kenya. It provides goal tracking, private accountability groups, check-ins, evidence, peer review and optional fine records. Contact brianbichage81@gmail.com about these terms.

By choosing ‘Agree to Privacy Policy and Terms’ when registering, you agree to these terms and acknowledge the privacy practices described in the Privacy Policy. This is not consent to advertising, unrelated data processing or a waiver of your legal rights. If you do not agree, do not create an account.

02

2. Accounts and security

Provide accurate account information, keep your sign-in details secure and tell us promptly if you suspect unauthorised access. Do not impersonate anyone, share another person’s account or create an account on their behalf without authority. You are responsible for your own use of the service, subject to applicable law and any failure on our part.

03

3. Users under 18

If you are under 18, read these terms and the Privacy Policy with your parent or legal guardian before creating an account. Their permission and any legally required consent to processing your personal information must be in place. Your parent or guardian should contact brianbichage81@gmail.com about consent and verification. Checking the agreement box yourself does not establish verified parental consent.

Use Kaizen with your parent or guardian’s guidance. Join groups they have reviewed, use invitations carefully and ask a trusted adult for help if another member makes you uncomfortable. Do not upload identity documents, passwords, a home address, precise location, school details or sensitive images as evidence. Do not disclose another person’s personal information without permission.

Discuss group rules and any optional fine arrangement with your parent or guardian before taking part. No user should pressure a young person into paying, accepting a fine or sharing evidence. A fine entry in Kaizen does not itself establish an enforceable debt or override protections for children.

Parents and guardians may contact us about a child’s use, data rights or withdrawal of consent. We may restrict an account or remove content while reviewing a concern. These terms do not remove Kaizen’s own obligations to protect children and process their information lawfully.

04

4. Private groups and respectful use

Group creators and administrators manage membership and settings within the app’s permissions. Active members can see the member directory, including names and emails, and group-shared activity. A private milestone and its evidence are visible only to its creator through the app. Take care when inviting people and deciding what to share.

Do not harass, threaten, exploit or discriminate against others; post unlawful, abusive, infringing or misleading content; expose private information without permission; bypass permissions; or disrupt the service. Report misuse to the contact address above. We may investigate and restrict access or content when reasonably necessary to protect users or comply with law.

05

5. Your content and evidence

You retain the rights you have in your notes, milestones, files and other content. You allow Kaizen to store, process, display and transmit that content as needed to provide the service to authorised people, consistent with the Privacy Policy. Only submit material you have the right to share.

You are responsible for the accuracy and appropriateness of what you contribute. Third-party links are subject to those services’ terms and availability. Kaizen cannot guarantee that evidence or a peer review is accurate, or that a goal will be achieved.

06

6. Reviews, progress and optional fines

Scores, approvals and progress figures are accountability tools, not professional, financial or legal advice. Resolve disagreements respectfully with the group and use the available review controls.

New groups start with fines off. Owners and administrators can enable fines and change the amounts for future deadlines. Turning fines off stops new fines while preserving existing ledger history. Review the group’s current settings before participating.

A fine is a recorded amount between group members, not a debt owed to Kaizen. Kaizen does not collect, hold, transfer, enforce or verify payment. Any settlement happens outside the app and is subject to the participants’ agreement and applicable law. Do not use the ledger for coercion or unlawful financial arrangements.

07

7. Availability, changes and responsibility

We work to keep Kaizen available and secure, but maintenance, outages and changes can interrupt the service. Features may change. We will identify material changes to these terms with a new version and date and provide appropriate notice or seek a new agreement where required.

Kaizen is a tool for personal and group accountability. Your decisions and off-platform arrangements remain your responsibility, subject to applicable law. Nothing in these terms excludes rights, remedies or responsibility that cannot lawfully be excluded.

08

8. Leaving, restrictions and your information

You may stop using Kaizen and contact brianbichage81@gmail.com to close your account or request access, correction or deletion of information. We verify requests as appropriate and review shared group records, evidence and applicable retention obligations before acting. The Privacy Policy explains those practices.

Group deletion can affect every member’s shared history. We may restrict access to protect people, investigate misuse or comply with law, taking account of the circumstances and applicable rights. Contact us to ask about an account restriction.

9. Questions and disputes

Raise a concern with Brian Bichage at brianbichage81@gmail.com so we can try to resolve it. These terms are governed by the laws of Kenya, subject to mandatory consumer, child-protection and data-protection rights that apply to you. They do not limit your right to contact a relevant regulator or seek a remedy available under law.
